In the latest ACMA Community Blog post, Fellow Ken Miller describes and attempts to eliminate some of the confusion surrounding certain types of guaranty agreements, including Continuing and Limited Guaranty Agreements, Non-Recourse Guaranty Agreements, and Completion Guaranty Agreements.
Miller concludes that understanding the uses and provisions of different types of guaranty agreements and how they're likely to be interpreted by California courts is critical in both the enforcement of the guaranties and the drafting and negotiation of the agreements.
