ACMA's National Mortgage Law Summary covers for each state, those areas of state law about which a mortgage lender would desire knowledge prior to engaging in a mortgage transaction in that state. The Summary, published every two years, covers topics such as forms of security instrument used, recording requirements, statutes to be waived, usual treatment of standard provisions, future advances, usury, guaranties, foreclosures, statutes of limitation, requirements for releases of lien, mortgage, documentary and transfer taxes, homestead issues, choice of law, receivership, labor and materialmen’s liens and title insurance. The National Mortgage Law Summary is not a substitute for local counsel and since laws change constantly and unpredictably, one should always seek a licensed attorney within the applicable state for current advice. However, it is the only summary of its kind prepared by highly-respected attorneys in each state.
